Terms of Service

These Terms of Service ("Terms") govern your use of the PriceDesk service operated by Pytches Advisory, LLC ("we," "us," or "our"). By purchasing or using PriceDesk, you agree to these Terms.

1. Service Description

PriceDesk provides custom-built pricing calculator web applications for trade and field service businesses. We build a calculator loaded with your specific rates, materials, and surcharges, delivered as a web app accessible from any phone, tablet, or computer. The service includes initial setup and ongoing maintenance of your calculator.

2. Pricing and Payment

The PriceDesk service costs a one-time setup fee of $299.00 plus a recurring monthly subscription of $49.00. Payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.

3. Setup and Delivery

After purchase, we will contact you to collect your pricing information (rates, materials, surcharges, and business rules). We aim to deliver your custom calculator within 48 hours of receiving your complete pricing information. Delivery timelines may vary based on the complexity of your rate structure.

4. Rate Updates

Your monthly subscription includes ongoing rate updates. If your prices change, contact us and we will update your calculator. There is no additional charge for rate updates while your subscription is active.

5. Cancellation

You may cancel your PriceDesk subscription at any time. Upon cancellation, your access to the calculator will remain active through the end of your current billing period. The one-time setup fee is non-refundable. No cancellation fees apply.

6. Acceptable Use

You agree to use PriceDesk for legitimate business purposes only. You may not:

• Resell, redistribute, or sublicense your PriceDesk calculator to third parties
• Use the service for any illegal or unauthorized purpose
• Attempt to reverse-engineer, copy, or replicate the calculator software
• Misrepresent pricing information generated by the calculator as a binding contract (quotes generated are estimates unless otherwise stated by your business)

7. Accuracy and Liability

PriceDesk calculators are built using the rates and rules you provide to us. We are not responsible for errors resulting from incorrect or incomplete pricing information supplied by you. You are responsible for verifying that the rates loaded into your calculator are accurate and current.

PriceDesk is provided "as is" without warranties of any kind, either express or implied. To the maximum extent permitted by law, Pytches Advisory, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

8. Intellectual Property

The PriceDesk software, design, and code remain the property of Pytches Advisory, LLC. Your subscription grants you a non-exclusive, non-transferable license to use your calculator for the duration of your active subscription. Your business data (rates, materials, pricing rules) remains your property at all times.

9. Privacy

Your use of PriceDesk is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Modifications to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Orange County, California.
